We note again that the so-called Blue States (such as Hawai’i, California, New York, etc.) no longer appear to believe that they are bound by limits in either the United States Constitution or their own State constitutions.
Attorney Alan Beck presented oral argument before the US supreme court. The case challenges a gun-control law from Hawaii. It is both the state law and the 9th circuit decision supporting it that are being challenged. The Hawaii law requires you to obtain expressed [stated] permission before you can enter private property with your legally concealed gun. That law applies even if that property is open to the public. That means every gas station, every grocery store, every shop or car dealership requires prior permission to enter. In theory, you need permission from the gun shop before you bring your gun into the shop to have it serviced. Note that the property line does not have to be marked. That means you broke the law when you pulled off the road onto the tire shop’s parcel to repair a flat tire, not when you opened the door at the tire shop.
Judge Roberts asked why he could walk up to your door and ask for your vote, but he couldn’t do so if he was armed.
Judge Barrett asked if the State could require black people to get prior expressed permission before they were allowed to enter private property like a restaurant or grocery store.
Judge Gorsuch asked how a single territorial law designed to disarm the freed black slaves after the [War between the States] was considered a majority view of the States at either the founding of our nation or at the ratification of the 14th amendment. That law (part of the black codes) was later deemed to be unconstitutional, so why did the gun-control lawyers cite it as standing precedent? Gorsuch also corrected the gun-control lawyers, pointing out that the right to bear arms is presumed, and that the government is required to justify each infringement on that right… every single time.
If someone says that all politicians are the same, then I want you to remember the questions these judges asked. They are defending our right to bear arms. They may do so imperfectly, but perfection isn’t the relevant standard. Democrat politicians opposed every one of these judges. The Democrat Appointed judges said you lose your right to bear when you step out your door.
The court is expected to release its ruling in June or July.
The reason the Democrats and the Democrat judges want the law is because of bigotry. A store owner might want to exclude gun owners, but he isn’t enough of a bigot to put up a no-gun-owners sign and announce his blatant bigotry to all of his customers and all his suppliers. The politicians want the bigotry hidden and taken for granted.. Just like the Democrat politicians did with the black codes back in the 1870s [after Reconstruction ended].
California and other States have tried a similar bit of nonsense. While Rob may be right about “bigotry,” TPOL believes it is more than just promoting bigotry: we have been fighting for a century a widespread effort to disarm Americans (as so much of the rest of the world has been) in order to prevent successful defense against tyranny, while increasing dependence on flawed government to supposedly protect most people.
We understand and support the right of property owners and even those who rent their property to decide whether someone can be armed or not on their property. However short-sighted that may be. We understand that lovers of liberty may not agree on how conflicts in basic human rights should be resolved. (Though we point out that the Zero Aggression Principle is based on treating one another as we would want to be treated, which translates into maximizing liberty for others.)
We submit that disarmament is just another form of slavery.
