The Republicans’ war on the Bill of Rights

In the three-part discussion of how the Democratic Party and their minions attack each and every part of the American Bill of Rights, TPOL promised we’d NOT forget that the GOP is just as much committed to that same goal.

As the “right” wing of the Old Party monster, Republicans have been dedicated to attacking individual liberties since the Party’s founding way back in 1854, as demonstrated by their candidates in 1856 and especially in 1860. (That was the year they nominated that railroad shyster and land development profiteer from Chicago, as you may recall.) For the most part, the GOP assault on the Bill of Rights (and ALL God-given liberties) has been less a matter of vocal overt attack that their actions. In other words, watch what I do and not what I say.

Try tribal tyranny – you won’t like it

Welcome to the Cheyenne River Sioux Tribe.

Tribal Chairman Harold Frazier is the two-term chairman of the Tribal Council which represents the four Lakota nations which today constitute the 22 communities of this entity in north central South Dakota. It is a poor land and people: the product of 7-9 generations of DC-enforced socialism on a grand scale. Where the surest method of being able to raise a functional and at least somewhat prosperous and educated family is to emigrate. Even to such places as the Twin Cities (Minneapolis-St. Paul, not Lead-Deadwood), Denver, or other pits.

Those “leaders” who are “successful” in tribal government are generally voracious parasites who feed off the taxpayers and future generations. Indirectly, of course – they feast off the welfare provided by DC to supposedly meet “treaty obligations.” They are often only corrupt tools of the FedGov bureaucracy, and when the Democrats are in power, of Congress and the White House. It is not a pretty picture, and one for which TPOL will no doubt be damned to perdition by those in Eagle Butte.

The Tribal Council is seen by many enrolled members and outsiders as a bunch of corrupt, elected tyrants who lord it over their own people – and anyone unwise enough to try to deal with them. Especially those non-Lakota who happen to live or work in CRST. The Tribe was one which locked down their entire nation (reservation) in 2020 because of the COVID-19 panic. This included blocking Federal and State highways with armed border stations, and denying people the right to travel. Tribal government is always eager to attack anyone they dislike – verbally, in print, or economically: not just the hated wasichu (white people).

So this latest vicious attack on State Government is motivated by many things. First is antipathy to any Republican in office. This is a legacy of history, right back to that monster, Honest Abe himself. He personally approved the execution of 38 Dakota men in 1862 after the Dakota defeat in a war against settlers and troops in Minnesota. (Actually, just 37 were actually Dakota, the 38th was a white man adopted into the tribe as a child.) Never mind that originally the juries had found 303 men guilty and sentenced them to death; Abe commuted the sentence of nearly 90% of them. It WAS a travesty of justice in many, many ways. But to blame 21st Century Republicans for Lincoln’s actions is irrational. (I know, nothing new about that.)

Second is the refusal of the State of South Dakota to give even more privileges and benefits to Lakota, Nakota, and Dakota people, and past efforts (NOT just under Republican administrations) to de-establish and hinder tribal government and actions.

Third is the fact that for at least the last five generations, most Lakota have been taught to hate anyone who has ANY Western European ancestry unless they also have enough Lakota or other AmerInd ancestry to qualify for enrollment. Even in tribes like the Cheyenne River, where many of the tribal members have at least SOME whitewash in their ancestry. (As does Mr. Frazier himself, based on his name, not his physical characteristics. Frazier, sometimes spelled Fraser, is a Scots family name, first immigrating to the States in the last half of the 19th Century.) There are a large number of CRST members who not only have German family names, but are blue-eyed and blonde – NOT common among truly pure-blood Lakota.

Frazier has been tribal chairman for eight years, so far. His apparent hatred of non-Lakota, especially wasichu has been pretty obvious for all that time.

This latest is an example. On 5 April, Governor Kristy Noem of South Dakota issued an executive order prohibiting state-funded schools from teaching “Critical Race Theory.” The Executive Order which so disturbs Mr. Frazier can be found at this link. Read it for yourself, and then consider what Mr. Frazier recently published: For sake of clarity TPOL reproduces the entire statement:

EAGLE BUTTE, South Dakota — On April 5, 2022, the Governor of the state of South Dakota has made it clear that the United States is not responsible for any of its actions. In true dictator fashion she is forbidding the educators of our children to hear, speak or discuss critical issues that would enable our future generations to solve the problems in which we have failed.

I condemn the recent executive order issued by the Governor of South Dakota for all the polished ugliness that it represents. I can go on being critical of the statement but I would like to tell you what it means for us. The style of leadership which dictates thought and restricts educators from encouraging critical thinking is not the leadership my people deserve.

This executive order [PDF] is divisive and contributes to the very political indoctrination that it professes to prevent. Under the cover of great virtue, the Governor is promoting a great evil by dictating the thoughts of our teachers and children.

This may earn her the title of champion to those who believe that the people are not responsible for their nation but as we have seen on the other side of the world when the people can claim ignorance of their governments actions, the government can attack other countries and commit atrocities. We must be critical of our leadership and own our governments as that is the everyday work of democracy.

Any law or order meant to restrict our freedom to teach and learn is a restriction on freedom.

This executive order tells every minority in the state of South Dakota that you do not care what you have done, what you are doing or what you will continue to do.

The truth must be taught and told.

Yes, Mr. Frazier, the truth must be taught and told. Including the truth about what you just published. I am probably as little a fan of Ms. Noem (or ANY GOP politician) as Mr. Frazier is, but I base my dislike of her on reality, and not a warped view of what she wrote. As with the recent vicious attacks on the Florida State government in their own version of “do not advocate hatred and bias” (aimed towards advocates and activists of homosexuality – and sexuality in general – to pre-school and grade-school children), his words twist what she actually wrote. And he then accuses her of doing exactly what HE has done.

That is what passes for politics and “civic discourse” even in South Dakota, much less the rest of these States, in 2022.

A correspondent shared this with me some time ago. It seems to be based on Kurt Vonnegut’s 1963 novel, Cat’s Cradle. And has apparently been misattributed to David Attenborough.

“If you catch 100 red fire ants as well as 100 large black ants, and put them in a jar, at first, nothing will happen. However, if you violently shake the jar and dump them back on the ground the ants will fight until they eventually kill each other. The thing is, the red ants think the black ants are the enemy and vice versa, when in reality, the real enemy is the person who shook the jar.

This is exactly what’s happening in society today. Liberal vs. Conservative. Black vs. White. Pro Mask vs. Anti-Mask. Vax vs. Anti-vax. Rich vs. poor. Man vs. woman. Cop vs. citizen. [Etc.] The real question we need to be asking ourselves is who’s shaking the jar… and why?”

End of the petrodollar? Return of the gold standard?

Many lovers of liberty – anarchists and even minarchists, have long called for a return to a gold standard. Completely gone since Tricky Dick killed it in 1973 on an American and worldwide basis, most people have assumed it would never return.

In recent years, more and more lovers of liberty and political economists have warned of the end of the petrodollar, that strange form of fiat money created nearly 50 years ago to try and replace gold, while allowing the insane inflation of the 1970s and 1980s. Especially the massive spending which has recently drowned not just the FedGov but most governments, Stateside and overseas, in the last three years.

The Democrats’ war on the Bill of Rights, Part C

As we have looked at the first seven articles of the Bill of Rights – and how the Democrats are attacking them, this last commentary may be a wee bit shorter. Still, we have to remember that both Republicans and Democrats do NOT limit themselves to direct attacks: they seek to pervert, corrupt, twist, and skew the plain meanings of the words and then denigrate the authors and those who voted to establish not just the Bill of Rights but ALL of the Constitution.

The last three articles suffer no less than the first seven. Again, it is NOT just the Democrats or their woke socialist and communist and Tranzi comrades that attack, ignore, twist and pervert the Bill of Rights. Indeed, I ask, do you know ANY Republican officeholder who had NOT shown their contempt (and/or ignorance) of more than one provision of the Bill of Rights? Perhaps not in word, but in deed?

The Democrats’ war on the Bill of Rights, Part B

Note: Although this commentary attacks the Democratic Party, much of its membership, leadership, and supporters, please do NOT think that the Republican Party (the GOP), its leadership, much of its membership, and its supporters do NOT have their own war on the Bill of Rights, liberty, and freedom.  That is a subject for another commentary.

In Part A, we discussed Articles 1-4. The FedGov’s (and most States’) report card on those is four F’s. It isn’t any better for the rest.

Article 5

While we think of this having only to do with legal matters, there is more to this “catch-all” amendment.  But it is not just about our so-called “justice system.”

No person shall be held to answer for a capital, or otherwise infamous crime, unless on a presentment or indictment of a Grand Jury, except in cases arising in the land or naval forces, or in the Militia, when in actual service in time of War or public danger; nor shall any person be subject for the same offence to be twice put in jeopardy of life or limb; nor shall be compelled in any criminal case to be a witness against himself, nor be deprived of life, liberty, or property, without due process of law; nor shall private property be taken for public use, without just compensation.

Our right to life, liberty, property and due process is supposedly beloved by the “liberals” in the Democratic Party. But the truth is far different. Their constant attacks on so-called Conservatives (and libertarians) for ignoring these rights are sheer hypocrisy.  The Regressives are indeed the pot calling the kettle black.

Perhaps the greatest regressive attack is government-funded abortion: the killing of unborn children is certainly a direct attack on life: there is no due process for the child in the womb, or increasingly only partially in the womb. At the same time, more and more “crimes” are NOT allowed to be a matter of indictment by a Grand Jury: instead, it is a political appointee or elected politician – self-serving in many ways – that decides whether or not to indict someone accused of a crime.  At the same time, the growing movement (especially in the last two years) to NOT prosecute many “minor” crimes (for example, California’s “nothing less than $1000” de  minimus enforcement) literally deprives more and more people of property with no hope of due process.

And as we’ve seen in recent weeks, all of these rights of life, liberty, and property are being eroded away by State legislatures and elected tyrants (governors) on a daily basis: most being Democrats. Consider Colorado, New Jersey, and New York to name a few.

Article 6

Most of this amendment has been a joke for years, particularly the right to a speedy and public trial. Judges and the entire “justice system” conspires daily to negate those rights.

In all criminal prosecutions, the accused shall enjoy the right to a speedy and public trial, by an impartial jury of the State and district wherein the crime shall have been committed, which district shall have been previously ascertained by law, and to be informed of the nature and cause of the accusation; to be confronted with the witnesses against him; to have compulsory process for obtaining witnesses in his favor, and to have the Assistance of Counsel for his defense.

While this is notable at all levels, since 9-11 the concepts embodied in this article have been eroded even further.  Whistleblower “protections” and “administrative law” procedures nullify this completely. And the “assistance of counsel” clause has been turned into a “Attorney Full Employment Plan” – in other words, welfare for lawyers (and the law schools).

Democrats, beholden to lawyers and their elite (the activists judges and justices), continue to degrade these protections. At the same time as they come up with more and more crimes that are not mala in se but just mala prohibita.

Article 7

Courtesy of the complete debasement of the so-called money – including the termination of the gold standard and infinite printing of money – this amendment is nearly meaningless and completely ignored.

In Suits at common law, where the value in controversy shall exceed twenty dollars, the right of trial by jury shall be preserved, and no fact tried by a jury, shall be otherwise re-examined in any Court of the United States, than according to the rules of the common law.

Even if we take into account that the 2022 US “dollar” is one-hundredth the value of the 1787 dollar ($20 = 1 ounce of gold then, now 1 ounce of gold is selling for nearly $2000), when was the last time anyone actually saw a jury in a case involving a “mere” $2000? Instead, we get an attorney (in a black robe) to decide  matters he almost certainly knows nothing about.

The jury system itself has been rendered nearly useless, in large part due to liberal efforts to ensure completely neutral (and brainless) juries which can be easily manipulated by judges and all the other lawyers. And more and more of the appeals DO have to do (indirectly, of course) with challenging the facts tried by a jury. Just as the power of a jury to judge the law has vanished, Democrats (and Republicans) have largely converted juries into advisory boards.

We will continue this discussion with Articles 8, 9, and 10 in the next part.

We must recognized that NO part of the Bill of Rights – no right recognized in it or considered to be inferred by it (such as our right to privacy) – is safe from the “liberals” or Regressives who control and dominate the Democratic Party. It doesn’t matter whether they are outright Socialists (or Communists) or not. (And again, the GOP is no different.)

If we do not understand this, we risk losing even more than we already have.  If we do understand, we can push back against those who want to drag us further into tyranny.

The Democrats’ war on the Bill of Rights, Part A

We here at TPOL looked at this problem about four years ago. (I know! The distant past, pre-COVID and pre-Uncle Joe! But bear with me.)

Most of us know that the Democratic record on “gun control” – opposition to the right to keep and bear arms” for at least the past half-century has been incredibly bad.  Even though not all call for the actual repeal of the 2nd Amendment, they try on a daily basis, across the Fifty States, to nullify and gut it.

But there is more in the Bill of Rights than our right to keep and bear arms that the majority of Democrats, and especially their leadership (including Uncle Joe and his puppet masters), want to get rid of.

Pollution and a young, surprisingly stable planet

Warning – what follows ain’t rocket science, but it is a wee bit complicated now and then. Don’t try to share with people you know are mentally challenged and buy whatever the media spews at them, unless you have the time to reason carefully with them.

From the American Institute of Economic Research (AIER) comes this:

Several years ago, Oceanospirillales microbes devoured up to fifty percent of the 800 million liters of oil pumped into the Gulf of Mexico by the Deepwater Horizon spill. Gene sequencing by University of Texas researchers has shown how several bacteria could break down aromatic hydrocarbons. The largest population concentration of these oil-eating bacteria has been found in the still largely uncharted Mariana Trench. It has been proposed that these microbes be weaponized against future ecological disasters, until the world abandons fossil fuels (IF it does so).

Amazing! Maybe our fossil fuel use will NOT destroy our planet! But there is more.
